Terms of Use

These Terms govern your use of Memento, provided by Fulminare Holdings LLC (“Fulminare,” “we,” “us,” or “our”). By downloading or using Memento, you agree to these Terms and Apple’s applicable Licensed Application End User License Agreement. If you do not agree, do not use Memento.

The practice and medical disclaimer

A philosophical practice, not therapy. It complements support; it does not replace it.

We do not offer medical advice. Any and all recommendations should be viewed as suggestions. Please consult with your doctor before making any medical decisions.

Memento is a reflection and wellness tool. It is not a medical device, health-care provider, crisis service, diagnosis, treatment, or substitute for professional care. Do not rely on Memento for emergencies. If you may harm yourself or someone else, contact local emergency services immediately; in the United States and its territories, call or text 988 for the Suicide & Crisis Lifeline.

Eligibility and appropriate use

You must be at least 13 years old and legally able to agree to these Terms. If local law requires parental consent, a parent or legal guardian must consent. You are responsible for deciding whether this reflective practice is appropriate for you and for stopping if it feels unsafe or unhelpful.

You may use Memento only for personal, lawful purposes. You may not misuse the service, interfere with its operation, evade access or rate limits, probe or extract credentials, reverse engineer where prohibited, infringe others’ rights, or use generated material to harm, threaten, deceive, or unlawfully discriminate.

Memento Premium subscriptions

• Memento Premium is offered as an auto-renewing monthly or yearly subscription. Current price, billing period, and any introductory offer are shown on the purchase screen before you confirm.
• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current billing period. Apple may charge your account within 24 hours before renewal.
• You can manage or cancel in your Apple Account subscription settings. Deleting Memento does not cancel a subscription.
• If an introductory free trial is offered, eligibility is determined by Apple. Any unused portion of a free trial is forfeited when you purchase the subscription where applicable.
• You may restore eligible purchases from Memento’s paywall, plan sheet, or Settings. Refund requests and billing disputes are handled under Apple’s policies.

Generated content

Memento uses automated systems to create personalized reflective sessions. Generated content may be inaccurate, incomplete, repetitive, or unsuitable for your circumstances. It is provided for reflection, not as fact or professional advice. You remain responsible for how you interpret and use it.

Ownership and license

Memento, its design, software, branding, and supplied content belong to Fulminare or its licensors and are protected by law. Subject to these Terms and Apple’s rules, Fulminare gives you a limited, personal, revocable, non-exclusive, non-transferable license to use Memento on Apple devices you own or control.

Availability and changes

We may update, change, suspend, or discontinue features to maintain safety, security, legal compliance, or service quality. Personalized generation requires network access and third-party services; the app may use its on-device library when generation is unavailable. We do not guarantee uninterrupted or error-free operation.

Privacy

Our Privacy Policy explains how Memento handles information and is part of these Terms.

Disclaimers and limitation of liability

To the fullest extent allowed by law, Memento is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will meet your needs. Fulminare and its members, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunity arising from Memento. Where liability cannot be excluded, our aggregate liability will not exceed the greater of the amount you paid for Memento in the 12 months before the claim or US $50. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted.

Termination, law, and changes

You may stop using Memento at any time; subscription cancellation is handled separately through Apple. We may suspend access for material misuse or legal necessity. These Terms are governed by the laws applicable to Fulminare Holdings LLC, without regard to conflict-of-law rules, except where your local consumer law requires otherwise. If part of these Terms is unenforceable, the remainder stays in effect.

We may update these Terms. We will update the date above and provide notice when legally required. Continuing to use Memento after an update means you accept the revised Terms to the extent permitted by law.
